കേസിന് ആസ്പദമായ സംഭവം 2020 കാലയളവിലാണ് കേസിലെ ഒന്നാംപ്രതി രണ്ടാം അച്ഛനായ കൊല്ലം പെരിനാട് ചെമ്മക്കാട് വില്ലേജ് ജംഗ്ഷനിൽ മന്ദിരത്തിൽ താമസം മാർട്ടിൻ മകൻ 41 വയസ്സുള്ള ജോഷ്വായും രണ്ടാം പ്രതി പെരിനാട് വില്ലേജിൽ ഇടവട്ടം നാന്തിരിക്കൽ ഡ്രോയസിൽ വിക്ടർ മകൾ 35 വയസ്സുള്ള ഷീജ എന്നിവരാണ് 2019 കാലയളവ് മുതൽ ഷീജ ഭർത്താവുമായി ബന്ധം വേർപെടുത്തി താമസിക്കുകയായിരുന്നു. കേസിലെ അതിജീവിതയെ സ്വന്തം പിതാവ് പീഡിപ്പിച്ചതിലേക്ക് മുൻപ് കേസ് ഉണ്ടായിരുന്നെങ്കിലും പ്രതിയെ കോടതി വെറുതെ വിട്ടിരുന്നു. അതിജീവിതയുടെ അനുജത്തി 15/01/2017 ൽ തൂങ്ങിമരിച്ചിരുന്നു
ആയതിന് ഉത്തരവാദിയായ അതിജീവിതയുടെ മാതൃ പിതാവിനെതിരെ പീഡനത്തിന് കുണ്ടറ പോലീസ് കേസെടുത്തിരുന്നതും പ്രതിയായ വിക്ടറിനെ കൊട്ടാരക്കര അതിവേഗ സ്പെഷ്യൽ ജഡ്ജി തുടർച്ചയായി മൂന്ന് ജീവപര്യന്തം തടവിനും വിധിച്ചിരുന്നു. ടി 3 ജീവപര്യന്തം തടവ് പ്രതി ജീവിതാവസാനം വരെ അനുഭവിക്കണമെന്ന് പ്രത്യേകത കൂടി ടി വിധി പ്രസ്താവനയിൽ ഉണ്ടായിരുന്നു
അപ്രകാരമായിരിക്കെ ഒന്നാംപ്രതി രണ്ടാം പ്രതിയോടൊപ്പം താമസമാക്കുകയും ടി അവസരത്തിൽ 16 വയസ്സുള്ള അതിജീവിതയോട് ഒന്നാം പ്രതി ലൈംഗികപരമായി പെരുമാറുകയും ആയതിനു വേണ്ട ഒത്താശ രണ്ടാംപ്രതി ചെയ്തു കൊടുത്തു എന്നുമായിരുന്നു കുണ്ടറ പോലീസ് ഇരുവർക്കും എതിരെ ചാർജ് ചെയ്തത്
എന്നാൽ പ്രതികൾക്കെതിരെ വ്യക്തമായ തെളിവുകൾ ഹാജരാക്കാൻ പ്രോസിക്യൂഷന് സാധിച്ചില്ല എന്ന് പ്രതിഭാഗം അഭിഭാഷകരായ സെബി.എസ് രാജ്, അൻസിയ മോൾ, ഷാജി പി അസീസ് എന്നിവരുടെ വാദം അംഗീകരിച്ച കൊല്ലം അതിവേഗ സ്പെഷ്യൽ ജില്ലാ ജഡ്ജി എസ്. സമീർ പ്രതികളെ നിരുപാധികം വെറുതെ വിട്ടു
